QUOTATIONS All quotations are given based on the information provided to Black Bear Printing by the customer. Quotation may be changed at time of submission, if actual order does not conform to the information for which original quotation was based. Any quotation not accepted within 10 business days is subject to change. ORDERS Black Bear Printing shall not be held liable for any jobs lost or damaged due to fire, water, strikes, theft, vandalism, acts of God and any other conditions beyond our control. Cancelled orders will be billed for any work incurred prior to cancellation. DEPOSIT/PAYMENT WILL NOT BE REFUNDED ON ANY CUSTOM ORDERS IN PROGRESS. Any claims for defects, damages or shortages must be made in writing within 48 hours. If no claim is made within this period, the order will be considered acceptable. Please check your order carefully!! CREATIVE WORK Any sketches, copy, proofs and all other creative work developed or furnished by Black Bear Printing are the exclusive property of Black Bear Printing. Written approval must be given to customer for use of said artwork, or and ideas derived from said artwork, outside of our facility. ELECTRONIC FILES It is the customers responsibility to maintain a copy of the original file. Black Bear Printing is not responsible for accidental damage to media supplied by the customer or for accuracy of final output. Any additional editing or programming needed to utilize customer supplied files will be charged at prevailing hourly rate. ($48/hr) PROOFS Black Bear Printing will provide all customers with a pre-press proof. It is the responsibility of the customer to thoroughly review contents of proof and advise, in writing, any changes/corrections that need to be made. Black Bear Printing is not responsible for any verbal approval or alteration, or any mistakes found after final proof approval. Press proofs are available for an additional fee. COLOR PROOFS Because of difference of monitor settings, equipment, paper, inks and other conditions between proofing and pressroom operations, a reasonable variation in color is to be expected. When this occurs, it will be considered acceptable. Match prints are available for an additional fee. There is a visible difference when spot color is converted to process color....ask to see the color chart! OVER/UNDER-RUNS 10% over/under is considered industry standard and customer will be billed accordingly. If customer requires a guaranteed quantity, it must be stated in writing upon quotation/order. DELIVERY/SHIPPING Local delivery, within 15 miles is included at no additional charge. Any delivery more than 15 miles and less than 30 miles, will be charged a flat rate of $20. Deliveries over 30 miles will be billed an additional 50 cents per mile. Rush orders are subject to additional fees. Orders shipped via USPS, UPS, FedEx, DHL, or other delivery service/currier will be billed at the current rate of that provider based on weight and final destination. Insurance is additional and is the customers responsibility. Black Bear Printing will not be liable for any items lost or damaged from shipping service. TERMS New customers must send payment in full with their first order. 50% deposit is required to proceed with any future order with balance to be paid upon completion. Custom orders are to be paid in full before order is placed. ALL PAYMENTS ARE DUE IN FULL 30 DAYS FROM INVOICE DATE. A late charge of 14% of balance due, per month, will be incurred for all invoices not paid in 30 days. We reserve the right to demand payment in full for any job at any time before production begins. Credit is available on balance due for customers "in good standing" who have completed a credit application. STORAGE Black Bear Printing agrees to store a completed job for a period of no more than 10 business days. After 10 business days, customer will be billed at the prevailing rate for storage. If storage is necessary beyond 10 business days, a storage contract must be signed prior to production of order. Black Bear Printing will not be liable for any items lost or damaged during storage. Any orders not picked up after 30 days will be considered abandoned and discarded. Customer is responsible for any outstanding invoice plus additional fees. TAXES All taxes will be added to your invoice. No tax exemptions will be granted unless an "Exemption Certificate" (or other proof of exemption) is provided with your order. INDEMNIFICATION (a) Customer certifies that items provided to be reproduced are not copyrighted or protected in any way, shape or form and that copyright information has not been removed from piece to be reproduced. Customer must sign an AUTHORIZATION TO REPRODUCE form for materials provided to Black Bear Printing, including original artwork or photographs. Black Bear Printing will not be liable for attorney or legal fees in connection with copyright infringement. (b) Customer also warrants that the material to be printed does not contain any information to threaten anyone's right to privacy or other personal or economic rights. Customer agrees to defend provider, at their own expense, in all legal actions resulting from negligence. Black Bear Printing reserves the right to refuse any job. SATISFACTION GUARANTEE  We take great pride in our commitment to customer satisfaction. If there is a mistake in the printing process your products will be re-printed at no additional charge. If the prints have already been shipped, we will issue you a pickup slip allowing you to return them at no cost. We can not be held responsible in the event of human errors such as:  - Spelling, punctuation or grammatical errors made by the customer.  - Inferior quality or low-resolution of uploaded images, or files not properly    converted to CMYK.  - Design errors introduced by the customer in the document creation process.  - Errors in user-selected options such as choice of finish, quantity or product type.   We ask that you doublecheck your designs for these common errors before ordering. Customer is responsible for checking accuracy of order received after delivery. Our liability is for printed materials only and will not include the customer's cost of mailing products or any other costs  associated after products have been received by the customer.
